For as long as I can remember, Judge Baird has been a Common Pleas Judge in Medina County. Additionally, for as long as I can remember, I have never known Judge Baird to render a decision against Old Phoenix National Bank.
It is difficult for me to understand how Old Phoenix had never lost a case before Judge Baird. One would think that Old Phoenix National Bank never did anything wrong. Or perhaps their attorneys are the best in the world.
I believe that Old Phoenix National Bank has influence. Their officers and directors must have, at one time or another, been associated or influenced Baird. It is a well-known fact that the former Common Pleas Judge Neil Whitfield had a very good relationship with Old Phoenix. In fact, Whitfield was able to help his son obtain a loan from Old Phoenix without having to guarantee the loan personally.
When Judge Whitfield's son went into bankruptcy owing Old Phoenix a great deal of money, Old Phoenix never pursued Whitfield's son for the money... Influence?
I had filed a Motion to recuse Judge Baird because he had ruled unfavorably in all cases regarding our family.
It was Baird that granted the foreclosure against John, Mike and me on the real estate that Old Phoenix had stolen from us.
Baird had ruled against Mike a few occasions where Mike had sued local Medina businessmen and Baird had chosen to rule against Mike without good legal opinion. Mike still lost the cases.
My desire to obtain an unbiased judge was soon replaced with my desire to get this lawsuit either started in Common Pleas or to finish the legal hassles and begin writing this book.
It was nearly seven years since I began suing everybody. I was tiring of all the lies and cover-ups by the defendants. If I could not use the law to defeat these thieves, then a book might expose them for what they really are.
I dropped my motion to recuse Baird thinking that he might render a decision in my favor once he had read the reasons why I was suing the conspirators. I still like to think that every once in awhile, (perhaps a great while) justice overtakes the greed or complacency of a judge in power and screams out loud to be heard. That justice will prevail and that the underdog has a better than average chance of becoming successful.
How wrong could I have been? Baird found it easy to dismiss my Fraud Complaint on the statute of limitations and never once addressed my claims that the conspirators deliberately hid documents and letters to keep me from finding the truth about their fraudulent deeds. Baird never stated anything about my discovering several documents hidden from me by the defendants. He just ruled against me and closed the final chapter of the litigation that I had started nearly eight years earlier.
